AutomAPI – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the AutomAPI platform, websites, applications, dashboards, APIs, integrations, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Introduction

AutomAPI (“we,” “us,” “our”) is a SaaS platform that enables businesses to automate messaging, notifications, and customer interactions using WhatsApp and related communication channels. Your access and use of the Service are subject to these Terms, as well as any applicable policies and guidelines referenced herein.

If you do not agree with these Terms, you may not access or use the Service.

2. Eligibility

By using the Service, you represent and warrant that:

• You are at least 18 years old (or the legal age in your jurisdiction); and

• You have full legal capacity to enter into these Terms on behalf of yourself or the entity you represent.

3. Account Registration & Security

1. Account Creation: You must register for an account to use certain features of the Service. You agree to provide accurate, complete, and up-to-date information.

2. Account Responsibility: You are responsible for all activities conducted using your account and must keep your password and account credentials secure.

3. Unauthorized Use: You must notify us immediately if you suspect any unauthorized use of your credentials.

4. Our Service & Your Use

1. Scope: The Service provides tools for messaging automation, template management, webhook integrations, analytics, scheduling, and related APIs.

2. Compliance: Your use of the Service must comply with all applicable laws and regulations, including data protection and communications laws.

3. Third-Party Requirements: The Service may connect with third-party systems (such as WhatsApp/Meta APIs). You are responsible for your compliance with their policies and terms.

5. WhatsApp/Meta Integration & Compliance

Because AutomAPI interacts with the WhatsApp Business Platform and associated APIs, you agree to abide by Meta’s rules, including:

• Obtaining valid opt-in consent before sending business-initiated messages. (Infobip)

• Using approved message templates when required by WhatsApp. (WhatsApp Business)

• Respecting WhatsApp’s messaging policies and quality standards. (WhatsApp Business)

You acknowledge that WhatsApp/Meta may enforce policies that affect your ability to use or send messages via their services, which AutomAPI does not control.

6. Valid Opt-In & User Consent

To send any business-initiated WhatsApp messages, you must first obtain an explicit opt-in from the recipient in accordance with WhatsApp and applicable legal requirements. A valid opt-in must clearly indicate that the user agrees to receive communications from your business and understands the types of messages they may receive. (Infobip)

You are responsible for capturing and storing opt-in consent, including time, source, and context.

7. Acceptable Use

You agree not to use the Service to:

• Send unsolicited or spam messages.

• Violate laws or WhatsApp/third-party policies.

• Impersonate another person or entity.

• Engage in harmful, deceptive, abusive, or fraudulent conduct.

AutomAPI may suspend or terminate accounts that breach these acceptable use terms.

8. Subscriptions, Fees & Billing

1. Subscription Plans: Use of the Service may require a subscription. You agree to pay all fees in accordance with the pricing and payment terms posted on our site.

2. Billing: Subscriptions recur automatically until cancelled.

3. Taxes: You are responsible for all applicable taxes.

9. Intellectual Property Rights

1. Our Rights: AutomAPI (and its licensors) retain all ownership and intellectual property rights in the Service, including software, content, designs, and APIs.

2. Your Rights: You retain ownership of your own content and data that you upload or generate using the Service.

10. Data & Privacy

1. Your Data: You are responsible for the data you input into the Service, including how you obtain and process personal data.

2. Privacy Policy: Our collection and use of personal information are governed by our Privacy Policy, available at /privacy_policy on our website.

11. Limitation of Liability

To the maximum extent permitted by law:

• AutomAPI and its affiliates shall not be liable for indirect, incidental, consequential, or special damages arising out of your use of the Service.

• Our total liability for any claim related to these Terms shall not exceed the amount you paid to AutomAPI in the three (3) months preceding the claim.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. AutomAPI does not guarantee uninterrupted access, error-free operation, or specific business results.

13. Termination

Either party may terminate your account and access at any time if you violate these Terms or if we choose to discontinue the Service.

Upon termination, all rights granted to you will cease immediately.

14. Changes to These Terms

We may update these Terms at any time. If we make a material change, we will notify you via email or our website. Continued use of the Service after such notice constitutes acceptance of the updated Terms.

15. Governing Law & Dispute Resolution
